STATUTORY
The factors, in plain words
- The health, safety and welfare of the child (Cal. Fam. Code §3011(a))
- A history of abuse by a parent or person seeking custody against the child, the other parent, or a parent, spouse, cohabitant or dating partner (independent corroboration may be required) (Cal. Fam. Code §3011(a))
- The nature and amount of the child's contact with both parents (Cal. Fam. Code §3011(a))
- Habitual or continual illegal drug use, alcohol abuse, or abuse of prescribed controlled substances (Cal. Fam. Code §3011(a))
§3020: health, safety and welfare is the primary concern; frequent and continuing contact with both parents is also policy - if they conflict, safety wins (§3020(c)). §3010: mother and presumed father are equally entitled to custody. §3044 adds a rebuttable presumption AGAINST custody/visitation for a parent found to have perpetrated domestic violence within the previous 5 years. The paternity gate in California
Form: Voluntary Declaration of Parentage (VDOP) - form CS 909 / DCSS 0909
Authority: Cal. Fam. Code §§7570-7577; §7611; §7630 et seq. (Petition to Determine Parental Relationship, form FL-200)
Rescission window: Within 60 days (§7575)
No default-custodian rule stated for CA in sizing §3. A filed VDOP establishes paternity with the same force and effect as a judgment and is a basis for establishing a custody, visitation or support order (§7573) - it is not itself a custody order. Being named on a birth certificate alone, without marriage or a VDOP, does not establish parentage.
