Can I Go to Jail for Child Support?
The honest shape of it
Unpaid support becomes dangerous when it becomes contempt: a court finds the arrears were willful — that you could pay and did not — and uses jail, or the threat of it, to force payment. Courts also use license suspension, passport certification, and tax-refund offsets long before jail. Criminal nonsupport is a separate track that exists in many states with its own elements. What varies by state — the exact contempt process, any thresholds, purge mechanics, and criminal exposure — varies enough that this page prints no state table: our verified data covers the enforcement facts below, and inventing the rest would be exactly the kind of table this site refuses to publish.
The enforcement facts that are verified
Arrears over $2,500 can be certified for passport denial or revocation under federal law. Tax-refund offsets reach $150 of arrears in assigned cases and $500 in non-TANF cases. In New York, a driver's license suspension can follow at arrears of four months of the current obligation. In Florida, a written DOR payment agreement can stop or reverse a license suspension. And in every state, each unpaid installment is a judgment that cannot be retroactively erased (Bradley Amendment).
The one move that stops the clock
Arrears grow at the old rate until someone files. If your income dropped, the modification filing — Door 1 — is what stops new arrears accruing at a rate you cannot pay. If the balance already exists, Door 2 is the lawful reduction track. Doing nothing is the only strategy that reliably ends in an enforcement office.
If you have a hearing date
Treat it as the emergency it is: bring proof of income, of job search, of payments, and of any filing you have made — and talk to a family-law attorney in your state before the date if you possibly can.
Questions
- Can I go to jail for child support arrears?
- Jail enters through contempt proceedings — a court finding willful nonpayment — or a separate criminal nonsupport charge where a state provides one. It is not automatic at any balance, and the exact process varies by state.
- What stops arrears from growing?
- A modification filing. Support can only be changed from filing or service forward, so filing early is what stops new arrears at the old rate.
- Can arrears be erased because I was jailed or lost work?
- No. Arrears that accrued while no modification was filed cannot be retroactively reduced, whatever the reason. That is the Bradley Amendment.
